Letters Probate is a court order appointing a person as executor of an estate. This order gives the appointed executor the authority to transfer or sell the deceased’s real estate and to withdraw the deceased’s assets from financial institutions.
To obtain Letters Probate, the person seeking to be appointed as executor needs to file an application with the Court of Queen’s Bench. This application includes information showing that the deceased’s Will was properly executed and detailing all of the deceased’s assets at the time of death.
